iDoctors - Terms of Service

1. INTRODUCTION

Welcome to the website of iDoctors ("Sivida srl", "we", "us", "our"). The Company is a company specialized in professional repairs of electronic devices, with a particular focus on iPhone, iPad, MacBook and multi-brand smartphones, operating through its stores in Milan.

These Terms of Service ("Terms") govern your use of our website idoctorstore.it ("Site") and the repair services offered by our company ("Services"). Please read these Terms carefully before using our Site or requesting our Services.

By accessing our Site and using our Services, you agree to be bound by these Terms. If you do not agree to all of the Terms, please do not use the Site and the Services.

2. DEFINITIONS

“Customer” : any natural or legal person requesting a Repair Service from iDoctors.

“Device” : any electronic device (including, but not limited to, iPhone, iPad, MacBook, smartphones or tablets of other brands) delivered to iDoctors for diagnosis or repair.

"Estimate" : estimate of repair costs provided by iDoctors after diagnosing the Device.

"Services" : all repair, diagnosis, data recovery or technical consultancy services offered by iDoctors.

"Site" : the website idoctorstore.it and all its subpages.

3. REPAIR SERVICES

3.1 Repair Process

The standard repair process at iDoctors includes the following steps:

a) Acceptance : The Customer delivers the Device to one of our points of sale or sends it via the agreed courier service, describing the problem encountered.

b) Diagnosis : Our specialized technicians examine the Device to identify the cause of the malfunction and determine the necessary intervention.

c) Estimate : The Customer is provided with a detailed Estimate including repair costs and estimated timescales.

d) Authorization : The Customer must explicitly approve the Estimate before iDoctors proceeds with the repair.

e) Repair : The technical team carries out the intervention according to the specifications agreed in the Estimate.

f) Quality control : Before being returned, the Device undergoes thorough testing to verify that the functionality has been restored correctly.

g) Return : The repaired Device is returned to the Customer or shipped to the indicated address.

3.2 Timings

Repair times vary based on the complexity of the intervention and the availability of the necessary components. iDoctors undertakes to respect the times indicated in the Estimate, but these times must be considered as an estimate and not as a mandatory deadline.

In case of unforeseen events that may extend the repair times, the Customer will be promptly informed.

3.3 Estimates and Payments

a) All Estimates provided by iDoctors are valid for 7 (seven) days from the date of issue.

b) In case of refusal of the Estimate, the Customer is required to collect the Device within 30 (thirty) days from the communication of the refusal. After this deadline, the device may be disposed of.

d) Payment for the Services may be made by cash (within the limits established by law), credit/debit cards, bank transfer or other electronic payment methods accepted by the Company.

e) Full payment is required prior to return of the repaired Device.

3.4 Spare Parts and Components

a) iDoctors uses high quality components for repairs, which may be original or compatible of equivalent quality, depending on availability and type of repair.

b) The Customer will always be informed of the type of components used before authorising the repair.

c) Components replaced during repairs become the property of iDoctors, unless otherwise agreed in writing with the Customer.

d) iDoctors undertakes to dispose of replaced components in compliance with current environmental regulations.

4. WARRANTY ON REPAIR

4.1 Warranty Coverage

a) All repair Services carried out by iDoctors are covered by a 3 (three) month warranty from the date of return of the Device.

b) The warranty covers only the replaced components and the interventions carried out during the original repair.

c) The warranty is not transferable and can only be exercised by the original Customer who requested the repair, presenting the original receipt or invoice.

4.2 Exclusions from the Warranty

The warranty does not cover:

a) Damage resulting from misuse, accidents, drops, exposure to liquids or extreme environmental conditions occurring after repair.

b) Malfunctions caused by software, viruses or other non-hardware issues.

c) Damage caused by repairs carried out by third parties after the repair by iDoctors.

d) Components subject to normal wear and tear (such as batteries, which have a limited 6-month warranty).

e) Issues not related to the original repair intervention.

f) Damage to data contained in the Device.

4.3 Warranty Application Procedure

To benefit from the guarantee, the Customer must:

a) Contact iDoctors within the warranty period.

b) Present the Device at one of the iDoctors points of sale or send it via an approved courier.

c) Provide original proof of purchase of the Repair Service (receipt or invoice).

d) Describe in detail the problem you encountered.

iDoctors will evaluate the Device to verify that the malfunction is covered by the warranty and will proceed with the free repair if the warranty conditions are met.

5. DATA RECOVERY AND PROTECTION

5.1 Data Backup

a) iDoctors strongly recommends that Customers perform a complete backup of the data contained in the Device before submitting it for repair.

b) iDoctors assumes no responsibility for any data loss that may occur during the repair process.

5.2 Data Recovery Service

a) iDoctors offers specialized data recovery services from damaged devices, with separate rates specified in the relevant Quote.

b) Successful data recovery cannot be guaranteed in all cases and depends on the nature and extent of the damage suffered by the Device.

c) In case of impossibility of recovery, a diagnostic cost may still be applied, which will be specified at the time of requesting the service.

5.3 Privacy and Confidentiality

a) iDoctors treats all data contained in Customer Devices with the utmost confidentiality, in compliance with our Privacy Policy and applicable laws on the protection of personal data.

b) Our technicians access the Device data only to the extent strictly necessary to perform the requested repair or service.

c) iDoctors does not keep copies of Customer data after the return of the Device, unless explicitly requested and authorised by the Customer.

6. WITHDRAWAL OF DEVICES

6.1 Return Terms

a) The Customer is required to collect the repaired Device within 30 (thirty) days of notification of completion of the repair.

6.2 Uncollected Devices

a) In the event of failure to collect the Device within 90 (ninety) days of notification of completion of the repair or rejection of the Estimate, iDoctors will send a formal communication to the Customer via WhatsApp message, email or PEC where possible.

b) If the Customer does not collect the Device within a further 30 (thirty) days from receipt of the formal communication, the Device will be considered abandoned.

c) In accordance with art. 927 et seq. of the Italian Civil Code, iDoctors will acquire ownership of the abandoned Device and may dispose of it at its discretion, including selling it to recover costs incurred.

7. LIMITATIONS OF LIABILITY

7.1 General Limitations

a) iDoctors is only liable for direct damages caused by gross negligence or intent in the performance of the Services.

b) iDoctors' liability is in any case limited to the market value of the Device at the time of delivery for repair, or to the price paid for the Service, whichever is lower.

7.2 Disclaimers

iDoctors is not responsible for:

a) Loss of data, software, information or content stored on the Device.

b) Indirect, incidental, special or consequential damages arising out of the use or inability to use the Device.

c) Delays in repairs due to force majeure or the unavailability of necessary components.

d) Pre-existing malfunctions not related to the requested repair intervention.

e) Manufacturing defects or issues covered by the manufacturer's warranty.

8. USE OF THE WEBSITE

8.1 License to Use

iDoctors grants you a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purposes.

8.2 Restrictions on Use

You may not:

a) Use the Site in a fraudulent or illegal manner.

b) Copy, modify, distribute, sell or rent any part of the Site.

c) Decompile or attempt to extract the source code of any software used on the Site.

d) Circumvent, disable, or interfere with the security features of the Site.

e) Use any robot, spider or other automatic device to access the Site.

8.3 Contents of the Site

a) All content on the Site, including text, graphics, logos, images and software, is the property of iDoctors or its licensors and is protected by copyright and intellectual property laws.

b) You may not use, copy or distribute such content without the express written permission of iDoctors.

9. ONLINE BOOKINGS

9.1 Booking System

a) The Site offers the possibility to book appointments for repair services at iDoctors stores.

b) Reservations are subject to availability and confirmation by iDoctors.

9.2 Cancellations and Modifications

a) Reservations can be cancelled or modified up to 24 hours before the appointment without additional costs.

10. INTELLECTUAL PROPERTY

a) All intellectual property rights relating to the Site and the Services offered by iDoctors, including but not limited to copyright, trademarks, logos, designs, are the exclusive property of iDoctors or its licensors.

b) Nothing in these Terms grants you any right to use iDoctors' intellectual property without our prior written permission.

11. PRIVACY

a) iDoctors collects and processes personal data in accordance with its Privacy Policy, which can be consulted on the Site.

b) By using the iDoctors Site and Services, you consent to the collection and processing of your personal data as described in the Privacy Policy.

12. CHANGES TO THE TERMS

a) iDoctors reserves the right to modify these Terms at any time by publishing the updated version on the Site.

b) The changes will be effective from the date of publication on the Site.

c) Your continued use of the Site or Services following the posting of changes constitutes acceptance of those changes.

13. APPLICABLE LAW AND JURISDICTION

13.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to principles of conflict of laws.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms, the Site or the Services shall be subject to the exclusive jurisdiction of the Court of Milan, Italy.

13.3 Alternative Dispute Resolution

In accordance with EU Regulation no. 524/2013 on online dispute resolution for consumers, we inform Customers residing in the European Union that they have the possibility of resolving disputes relating to the purchase of Services through the ODR (Online Dispute Resolution) platform of the European Union accessible at: https://ec.europa.eu/consumers/odr/.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and iDoctors relating to the subject matter hereof and supersede any prior or contemporaneous agreements or understandings, written or oral.

14.2 Waiver

iDoctors' failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.3 Partial Invalidity

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

14.4 Assignment

You may not assign or transfer these Terms, in whole or in part, without the prior written consent of iDoctors. iDoctors may assign or transfer these Terms without restriction.

14.5 Force Majeure

iDoctors shall not be liable for any failure to perform any obligation under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes or shortages of transportation, fuel, energy, labor or materials.
